1. License Grant
JidoQ (Pty) Ltd ("we", "us", "our") grants you a limited, non-exclusive, non-transferable, revocable license to access and use the webProfile CV website builder and hosting service (the "Service") solely for creating, publishing, and maintaining your personal professional profile website ("Your Site") in accordance with this Agreement.
2. Scope of Permitted Use
You may use the Service to:
- Create and customize a CV website using our templates and design system
- Publish Your Site on a webProfile subdomain (e.g.,
yourname.webprofile.app) or connect a custom domain you own - Export your site content in standard formats (HTML, PDF) for backup or migration
- Integrate with LinkedIn for profile data import as described in our Privacy Policy
You may not: sublicense, resell, or white-label the Service; reverse engineer or attempt to extract source code; use the Service for any unlawful purpose or in violation of any third-party rights; or remove or alter any proprietary notices.
3. Subscription & Billing
The Service is provided on a subscription basis via PayFast. Current plans:
- Monthly: R30 per month, billed monthly in advance
- Annual: R330 per year (equivalent to R27.50/month), billed annually in advance
Prices are quoted in South African Rand (ZAR) and include VAT where applicable. Fees are non-refundable except as set out in our Refund Policy. We may change pricing with 30 days' notice; continued use constitutes acceptance.
4. Intellectual Property
webProfile retains all right, title, and interest in and to the Service, including templates, design system, underlying code, APIs, and trademarks. You retain ownership of the content you upload (text, images, documents) and the resulting Your Site output. By uploading content, you grant us a worldwide, royalty-free license to host, store, reproduce, and display that content solely to operate the Service.
5. User Obligations
You agree to:
- Maintain accurate account information and secure credentials
- Comply with all applicable South African laws, including POPIA (Protection of Personal Information Act)
- Not upload content that is defamatory, infringing, illegal, or violates privacy rights
- Not exceed reasonable usage limits (storage, bandwidth, API calls) as defined in our fair use policy
6. Service Availability & Hosting
The Service is hosted on Cloudflare's global network, including edge locations outside South Africa. While we target 99.9% uptime, we do not guarantee uninterrupted access. Cross-border data transfers are subject to Section 8 of our Privacy Policy. Scheduled maintenance windows will be communicated via email at least 48 hours in advance.
7. LinkedIn Integration
If you choose to sign in or import data via LinkedIn, you authorize us to access your public profile, email address, and other data you permit via LinkedIn's OAuth flow. We use this data solely to pre-populate your CV website. See Privacy Policy for details on data retention and your rights.
8. Term & Termination
This Agreement begins on acceptance and continues until terminated. You may terminate by closing your account in Settings. We may terminate or suspend access immediately for material breach, non-payment, or legal compliance. Upon termination, your license ends; we will retain your data for 30 days per our data retention schedule, then delete it unless legally required to retain longer.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless webProfile, its directors, employees, and affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of this Agreement or applicable law.
12. Governing Law & Dispute Resolution
This Agreement is governed by the laws of the Republic of South Africa. Any dispute shall be resolved first by good-faith negotiation, then by binding arbitration in Johannesburg under the Arbitration Act 42 of 1965, unless either party seeks urgent injunctive relief in the High Court of South Africa.
13. General
This Agreement constitutes the entire understanding between you and webProfile regarding the Service. If any provision is found unenforceable, the remainder remains in effect. No waiver of any right constitutes a continuing waiver. You may not assign this Agreement without our written consent; we may assign freely.
