1. Acceptance of Terms
By accessing or using the webProfile platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms incorporate by reference our End User License Agreement, Privacy Policy, and Refund Policy.
2. Definitions
- "webProfile", "we", "us", "our" — JidoQ (Pty) Ltd, a company registered in South Africa.
- "You", "User" — The individual or entity accessing or using the Service.
- "Your Site" — The CV website you create and publish using the Service.
- "Content" — All text, images, documents, and data you upload or input.
- "Subscription" — Your paid plan (Monthly or Annual) via PayFast.
3. Account Registration
To use the Service, you must create an account. You may register using email/password or via LinkedIn OAuth. You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
4. Subscriptions & Payments
webProfile offers two subscription tiers, billed via PayFast in South African Rand (ZAR):
- Monthly: R30/month, auto-renewing monthly
- Annual: R330/year (save ~8%), auto-renewing annually
All prices include VAT at the prevailing South African rate. Payments are processed by PayFast; we do not store full card details. Failed payments trigger a 7-day grace period; after which the Service may be suspended. See Refund Policy for cancellation and refund terms.
5. Your Content & Responsibilities
You retain full ownership of Your Content. You grant webProfile a non-exclusive, worldwide, royalty-free license to host, store, cache, reproduce, and display Your Content solely to operate and improve the Service.
You represent and warrant that Your Content:
- Does not infringe any intellectual property, privacy, or publicity rights
- Is not defamatory, obscene, hateful, or unlawful under South African law
- Does not contain malware, spam, or deceptive material
- Complies with POPIA regarding any personal information of third parties
We may remove Content that violates these Terms upon notice, but we have no obligation to pre-screen or monitor Content.
6. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or to facilitate illegal activity
- Attempt to gain unauthorized access to systems, data, or other users' accounts
- Interfere with the Service's operation, security, or performance
- Scrape, crawl, or extract data from the Service without permission
- Resell, sublicense, or white-label the Service
- Use the Service to send unsolicited communications
7. LinkedIn Sign-In & Data Import
If you sign in via LinkedIn, you authorize webProfile to access your public profile, email address, and any other data you consent to share via LinkedIn's OAuth consent screen. We use this data exclusively to pre-populate your CV website fields. You may disconnect LinkedIn at any time in Settings; we will delete imported LinkedIn data within 30 days. 8. Service Availability & Modifications
We strive for 99.9% uptime on Cloudflare's global network. However, the Service may be temporarily unavailable for maintenance, updates, or unforeseen outages. We may modify, suspend, or discontinue any feature with reasonable notice (except for security or legal emergencies). We are not liable for any loss of data or revenue during downtime.
9. Cross-Border Data Transfers
Your data is processed and stored on Cloudflare infrastructure, which may involve transfers to countries outside South Africa. We rely on Cloudflare's Standard Contractual Clauses and adequacy decisions to safeguard such transfers. See Privacy Policy §8 for details.
10. Cookies & Tracking
The Service uses essential cookies for authentication, session management, and security. We also use analytics cookies (with your consent via our cookie banner) to understand usage. You may manage preferences via the cookie banner or your browser settings. See our Privacy Policy for the full cookie list.
11. Intellectual Property
webProfile owns all rights to the Service, including templates, design system, code, APIs, and trademarks ("webProfile IP"). These Terms do not grant you any rights to webProfile IP beyond the limited license in the EULA. You may not copy, modify, distribute, or create derivative works of webProfile IP.
12. Feedback
If you provide feedback, suggestions, or ideas ("Feedback"), you grant us a perpetual, irrevocable, royalty-free license to use, disclose, and exploit the Feedback without restriction or compensation.
13. Term & Termination
These Terms remain in effect while you use the Service. You may terminate by deleting your account in Settings. We may terminate or suspend for: material breach, non-payment, legal compliance, or extended inactivity (12+ months). Upon termination, your license ends; Sections 5, 9, 11, 13–15 survive.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT RESULTS WILL BE ACCURATE OR RELIABLE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED FEES PAID IN THE PRIOR 12 MONTHS. THIS LIMITATION APPLIES REGARDLESS OF LEGAL THEORY.
16. Indemnification
You will indemnify and hold harmless webProfile and its affiliates from any claims arising from your Content, use of the Service, violation of these Terms, or violation of any third-party rights.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of South Africa. Disputes shall be resolved by negotiation, then binding arbitration in Johannesburg under the Arbitration Act 42 of 1965, except for urgent injunctive relief in the High Court.
18. Changes to Terms
We may update these Terms with 30 days' notice via email and in-app notification. Continued use after the effective date constitutes acceptance. If you disagree, you must terminate your account before the changes take effect.
19. General
These Terms constitute the entire agreement. No waiver is continuing. You may not assign without consent; we may assign freely. If any provision is unenforceable, the rest remains valid. Headings are for convenience only.
